Zap Learning LLC Waiver & Release Agreement

Assumption of Risk Policy

By enrolling in any Zap Learning LLC activity, the participant or their parent/guardian acknowledges and voluntarily assumes all risks associated with participation. These risks include, but are not limited to, physical injury, illness, property damage, or other unforeseen incidents that may occur while engaging in STEM-related activities, using any equipment or materials, or receiving instruction and training.

The participant or their parent/guardian expressly waives and releases any claims they may have, now or in the future, against Zap Learning LLC, its owners, affiliates, operators, employees, agents, and officers, arising from participation in the activities or use of any equipment. This release applies even to claims resulting from the negligent acts or omissions of Zap Learning LLC and its representatives. However, nothing in this policy shall be construed to release liability for gross negligence or intentional misconduct.

Release of Liability Policy

The participant or their parent/guardian agrees to release, indemnify, and hold harmless Zap Learning LLC, its owners, affiliates, operators, employees, agents, and officers from any and all liability, claims, demands, actions, costs, or expenses arising from any loss, damage, injury, death, or other harm suffered by the participant while engaging in program activities, including the use of any equipment or materials provided by Zap Learning LLC.

This release explicitly includes claims arising from the negligent acts or conduct of Zap Learning LLC, its owners, affiliates, operators, employees, agents, and officers, to the fullest extent permitted by law. The participant and their parent/guardian acknowledge that participation in hands-on STEM activities carries inherent risks, both foreseen and unforeseen, and they voluntarily accept those risks as a condition of participation.

Medical Authorization & Responsibility

The participant or their parent/guardian assumes full responsibility for any medical expenses incurred due to injury or illness sustained while participating in Zap Learning LLC activities. The participant or their parent/guardian acknowledges that Zap Learning LLC does not provide medical insurance and that any required medical treatment is solely the financial responsibility of the participant or their parent/guardian.

In the event of an accident or medical emergency, Zap Learning LLC staff may, at their sole discretion, procure medical treatment for the participant without prior consent if the parent or guardian is unavailable. The participant and their parent/guardian waive any claims against Zap Learning LLC and its staff for medical treatment decisions made in good faith.

Payment & Cancellation Policy

Payment Requirements

  • Enrollment can be secured either through full payment or a non-refundable deposit per child.
  • If securing with deposit, the remaining balance is due two weeks before the class start date to maintain enrollment.
  • Both deposit payments and full payments are non-refundable except under specific conditions outlined below.

Cancellation & Refund Policy

  • Cancellation by Participant: All registrations are final. Refunds are only provided in exceptional circumstances and are reviewed on a case-by-case basis. In most cases, payments are non-refundable.
  • Session Transfers: If a participant needs to transfer to a different session, they must notify Zap Learning LLC as soon as possible. Transfers are subject to availability.
  • Medical Cancellation: If a participant is unable to attend due to a medical issue, they may request a session transfer. Transfers are subject to availability and may require documentation.
  • Cancellation by Zap Learning LLC: If a session is canceled due to low enrollment, facility issues, or any unforeseen circumstances, participants will receive a full refund.

Media Release Policy

The participant or their parent/guardian agrees to waive any ownership rights to photographs, videos, or other media captured by Zap Learning LLC during program activities. The participant and their parent/guardian grant Zap Learning LLC the irrevocable right to use, publish, and distribute such media in print, digital, and electronic formats, including but not limited to:

  • Promotional materials, including brochures, flyers, and presentations.
  • Website content, social media platforms, and online marketing.
  • Any other media or marketing materials used to promote Zap Learning LLC programs.

Additionally, Zap Learning LLC may share such media with third-party partners (such as schools, community centers, or co-promotional organizations) for joint marketing purposes. The participant and their parent/guardian waive any claims related to privacy, compensation, or misappropriation of likeness.
